June 28, 2010 -- The U.S. Supreme Court today granted review of a decision upholding an Arizona statute that both imposes severe state sanctions on employers who allegedly have hired an undocumented worker and requires employers to use the voluntary federal E-Verify program to attempt to check work authorization status electronically.
The state statute at issue is being challenged by a coalition of business groups and non-profit organizations as preempted under the Supremacy Clause of the U.S. Constitution. The Ninth Circuit Court of Appeals previously rejected the challenge.
