Michael Rubin Named to the Daily Journal’s “Top 100” California Attorneys list

Sixth time the Altshuler Berzon partner has been honored

September 21, 2022 – The California Daily Journal named Altshuler Berzon LLP partner Michael Rubin as one of the Top 100 Attorneys in California, for the sixth straight year. Referring to his “distinguished pedigree as an appellate and impact class action lawyer at Altshuler Berzon LLP,” the Daily Journal focused on Rubin’s efforts in Viking River Cruises v. Moriana, U.S. Supreme Court No. 20-1573, and the upcoming Adolph v. Uber Technologies, Inc., Cal. Sup.Ct. No. S274671, two cases in which employers tried to use mandatory pre-dispute arbitration agreements to strip workers of their right to pursue pursuing representative action claims under California’s Private Attorney General Act (“PAGA”). Rubin is quoted as being “upbeat” about the eventual result in these and many similar cases, which ultimately turn on an issue of California law. Although the U.S. Supreme Court’s characterization of that California law favored the employer, Rubin predicted that, Viking River “may turn out to be one of the shortest-lived Supreme Court victories [for employers] in history” because he believes the California Supreme Court will likely reject that characterization in Ubereffectively transforming an 8-1 loss in the Supreme Court into a near-complete victory for workers seeking to vindicate their state statutory rights, including under PAGA.
