On August 21, 2026, the D.C. Circuit unanimously rejected janitorial employer Preferred Building Services’ challenge to an NLRB decision finding that Preferred engaged in unlawful retaliation against employees who protested against low wages, poor working conditions, and alleged sexual harassment. SEIU Local 87 supported the workers in organizing the protests, filed unfair labor practice charges with the NLRB after Preferred terminated the workers for protesting, and intervened in the D.C. Circuit to defend the NLRB’s decision. The D.C. Circuit sided with the Union and rejected all of Preferred’s arguments challenging the NLRB’s decision on Preferred’s secondary and recognitional picketing defenses and order of make-whole relief for the workers.
