On May 22, 2025, U.S. District Court Judge Susan Illston granted a preliminary injunction preventing numerous federal agencies from implementing President Trump’s Executive Order 14210 to reorganize the federal government. Judge Illston found that the plaintiffs are likely to succeed on their claims that the Executive Order violates separation of powers principles, that the Office Management and Budget’s (OMB), Office of Personnel Management’s (OPM), and Department of Government Efficiency’s (DOGE) actions enforcing the Executive Order are ultra vires, and that OMB’s and OPM’s actions violate the Administrative Procedure Act. The plaintiffs are a coalition of unions, non-profit organizations, and local governments represented by Altshuler Berzon LLP and co-lead counsel Democracy Forward, as well as by co-counsel Protect Democracy, the Public Rights Project, and State Democracy Defenders Fund.
