Federal District Court Rules That Trump Administration’s Office of Personnel Management Unlawfully Ordered Federal Worker Terminations

On September 12, 2025, U.S. District Judge William H. Alsup entered judgment in favor of the plaintiffs in American Federation of Government Employees v. Office of Personnel Management, ruling that the Office of Personnel Management (OPM) unlawfully ordered other federal departments and agencies to terminate thousands of their probationary employees in February 2025. The Court ruled that OPM exceeded the legal authority granted to it by Congress by directing the employment decisions of other agencies and that OPM’s actions were arbitrary and capricious. The plaintiffs are a coalition of labor unions and nonprofit organizations, and the State of Washington, and are represented by Altshuler Berzon LLP and State Democracy Defenders Fund.
