Federal Employee Unions File Suit to Block Unlawful Mass Firing During Government Shutdown

September 30, 2025

American Federation of State County and Municipal Employees (AFSCME) and American Federation of Government Employees (AFGE) along with local affiliates filed a lawsuit challenging the Trump administration’s unlawful directive to agencies to engage in mass firings of federal workers in the event of a government shutdown. The Plaintiffs are represented by Altshuler Berzon LLP, Democracy Forward, and Democracy Defenders Fund. The lawsuit, filed on Tuesday, September 30, 2025, in the United States District Court for the Northern District of California, alleges that actions by the Office of Management and Budget (OMB), through its Director Russell Vought, and the Office of Personnel Management (OPM), through its Director Scott Kupor, violate the Administrative Procedure Act.
