Taxpayers sue University of California for policy of discrimination based on immigration status

California taxpayers represented by attorneys from Altshuler Berzon LLP, the Center for Immigration Law and Policy at the University of California Los Angeles, and Organized Power In Numbers have filed a lawsuit against the University of California for discriminating against undocumented students enrolled in the University. The suit, filed as a petition for writ of mandate in the California Court of Appeal, alleges that the University unlawfully discriminates against undocumented students by refusing to consider them for on-campus employment opportunities, based on a mistaken interpretation of federal immigration law. Most current undocumented students enrolled in the University lack access to the Deferred Action for Childhood Arrivals program, which provided work authorization for some undocumented young people. The University’s policy causes serious economic hardship and often also prevents students from obtaining work experience that is necessary to completing their degree programs. The petitioners are asking the Court of Appeal to act promptly on the petition, in time for applicants for the 2025-2026 school year to know whether they will be eligible for on-campus work opportunities. A copy of the writ petition filed on October 1 is available here.
